These Terms of Service (“Terms”) govern your access to and use of the Agni Pickles website at www.agnipickles.com, your customer account, and any products or services purchased from Agni Pickles.

In these Terms, “Agni Pickles,” “we,” “us,” and “our” refer to the business operating the Agni Pickles website and store. “You” and “your” refer to the customer or website user.

By accessing our website, creating an account, placing an order, or enrolling in a subscription, you agree to these Terms. If you do not agree, please do not use the website or purchase our products.

Our Privacy Policy, Refund Policy, Shipping Policy, Subscription Policy, and any terms displayed at checkout form part of these Terms. Mandatory rights provided by applicable law always take precedence.

1. Eligibility and website use

To place an order, you must be at least the age of majority in your province or territory of residence or have the permission and supervision of a parent or legal guardian.

You agree to use the website only for lawful purposes. You must not:

  • use the website for fraudulent, unlawful, or unauthorized activities;

  • interfere with the operation or security of the website;

  • introduce viruses, malicious code, or other harmful material;

  • attempt to access another person’s account or restricted systems;

  • collect information from the website using unauthorized automated methods;

  • submit false, misleading, abusive, or unlawful content; or

  • use our website or content in a way that infringes another person’s rights.

We may restrict or suspend access to the website if we reasonably believe these Terms have been violated.

2. Customer accounts

You are responsible for providing accurate and current account information and for keeping your login credentials secure.

You are responsible for activity conducted through your account unless it results from circumstances for which you are not legally responsible. Please notify us promptly if you believe your account has been accessed without authorization.

We may suspend or close an account where reasonably necessary to address fraud, misuse, security concerns, or a violation of these Terms.

3. Product information and availability

All products are subject to availability.

We make reasonable efforts to present accurate product descriptions, ingredients, sizes, prices, colours, and images. Because our products are handcrafted, reasonable variations in colour, texture, appearance, and consistency may occur between batches.

Packaging, recipes, ingredients, and product information may occasionally be updated. Always review the label on the product you receive before consuming it. If the information on the website appears inconsistent with the product label, please contact us before consuming the product.

We may correct errors, inaccuracies, or omissions on the website. We may also update product information and availability at any time, but changes will not retroactively alter an order that we have already accepted unless you agree or applicable law permits the change.

4. Food safety, ingredients, and allergens

Customers must review all ingredient lists, allergen declarations, storage instructions, and other information on the product packaging before consumption.

Do not assume that a product is free from a particular allergen unless we expressly state that it is. If you have a severe allergy, sensitivity, medical condition, or dietary restriction, please contact us before purchasing and consult an appropriate healthcare professional when necessary.

Products must be stored and handled according to the instructions on their packaging, including refrigeration after opening where applicable. Do not consume a product if its seal is broken, its packaging is damaged, or it appears unsafe or spoiled. Contact us promptly if this occurs.

Information on our website is provided for general informational purposes. It is not medical or nutritional advice, and our products are not intended to diagnose, treat, cure, or prevent any disease.

Nothing in these Terms limits Agni Pickles’ responsibilities under applicable food-safety, product-labelling, or consumer-protection laws.

5. Orders and acceptance

Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges that we received your order but does not necessarily mean that the order has been accepted.

We may refuse, limit, or cancel an order for legitimate reasons, including:

  • insufficient inventory;

  • an obvious pricing or product-information error;

  • unsuccessful or unauthorized payment;

  • suspected fraud or misuse;

  • delivery restrictions; or

  • a violation of these Terms.

If we cancel an order after payment has been collected, we will refund the affected amount to the original payment method unless another method is required by law or agreed with you.

We will not substitute a different product without your permission.

You are responsible for providing complete and accurate billing, shipping, delivery, and contact information. Please contact us immediately if you notice an error. Once an order has entered processing or shipment, we may not be able to change or cancel it.

6. Prices, taxes, and payment

Prices are displayed in Canadian dollars unless another currency is expressly shown.

Applicable taxes, shipping charges, duties, and other charges will be disclosed during checkout before you submit your order. Any mandatory charges imposed by Agni Pickles will be included or clearly disclosed as required by law.

Prices and promotions may change for future purchases without notice. A price change will not affect an order already accepted, except where an obvious pricing error occurred and applicable law permits the order to be cancelled.

Payments are processed by third-party payment providers. By submitting payment information, you confirm that you are authorized to use the selected payment method and authorize the applicable charges.

Agni Pickles does not directly store complete payment-card numbers. Payment providers process payment information according to their own terms and privacy practices.

7. Promotions, discounts, rewards, and gift cards

Promotions, discount codes, loyalty rewards, referral rewards, and gift cards may be subject to additional terms displayed with the applicable offer.

Unless expressly stated otherwise:

  • promotional offers cannot be combined;

  • discounts have no cash value;

  • offers apply only during the stated promotional period;

  • product and quantity restrictions may apply; and

  • promotions may be corrected or withdrawn where there is an error, misuse, or fraud.

Any cancellation or correction will remain subject to applicable consumer-protection law. Gift cards are also subject to applicable gift-card laws.

8. Subscriptions

Certain products may be available through an automatically renewing subscription.

When you select a subscription, you authorize Agni Pickles and its payment provider to charge your chosen payment method at the frequency and price disclosed when you subscribe, until the subscription is cancelled.

The discount, delivery frequency, renewal terms, cancellation process, and subscription-management options displayed when you subscribe and described in our Subscription Policy form part of your subscription agreement.

You can manage an eligible subscription through your Agni Pickles customer account. Cancelling a subscription stops future renewals but does not automatically cancel or refund an order that has already been processed.

If there is a conflict concerning a subscription-specific matter, the Subscription Policy and the terms shown when you subscribed will apply, subject always to applicable law.

9. Shipping, delivery, and pickup

Shipping and delivery are governed by our Shipping Policy and the delivery information shown at checkout.

Delivery dates and times are estimates unless we expressly guarantee a particular date. Delays may occur because of carrier disruptions, weather, traffic, customs, incorrect address information, or other circumstances outside our reasonable control.

For local delivery, an order may be left at the delivery address if no one is available and unattended delivery is permitted by your instructions or the selected delivery service. Customers should retrieve delivered food products promptly and follow all storage instructions.

You are responsible for confirming that your delivery address is accurate and accessible. Please update the address associated with an active subscription before the next subscription order is processed.

Nothing in this section limits any remedy available when an order is not delivered, is delivered incorrectly, or arrives damaged.

10. Cancellations, returns, and refunds

Returns, exchanges, cancellations, damaged products, incorrect orders, and refunds are governed by our Refund Policy.

Because our products are food items, processed or delivered orders may be final sale except where a product arrives damaged, defective, unsafe, or incorrect, or where applicable law requires another remedy.

If there is a problem with an order, please contact us within the period stated in our Refund Policy and provide:

  • your order number;

  • a description of the problem; and

  • clear photographs of the product and packaging where applicable.

Nothing in these Terms or our Refund Policy limits a refund, replacement, cancellation right, warranty, or other remedy that cannot legally be excluded.

11. Privacy and communications

Our collection, use, disclosure, retention, and protection of personal information are governed by our Privacy Policy.

We may send transactional messages necessary to process an order, provide delivery updates, manage a subscription, respond to an inquiry, or communicate important account information.

We will send promotional emails or messages only where permitted and based on the applicable consent. You may withdraw your marketing consent using the unsubscribe method provided in the message or by contacting us. Withdrawal from marketing does not prevent necessary transactional communications.

12. Reviews and customer content

If you submit a review, photograph, comment, recipe, testimonial, or other content to our website, you confirm that:

  • you created the content or have permission to submit it;

  • the content is truthful and reflects your genuine experience;

  • it does not infringe another person’s rights; and

  • it is not unlawful, threatening, defamatory, deceptive, or abusive.

You retain ownership of your content. You grant Agni Pickles a non-exclusive, royalty-free licence to use, reproduce, display, and distribute that content in connection with our website, products, and marketing, subject to our Privacy Policy and applicable law.

We may moderate or remove content that violates these Terms, but we are not obligated to publish every submission.

13. Intellectual property

The website and its content—including the Agni Pickles name and logo, photographs, graphics, text, product presentation, and original designs—are owned by or licensed to Agni Pickles and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial shopping purposes. You may not copy, reproduce, republish, sell, modify, distribute, or commercially exploit our protected content without prior written permission.

No ownership rights are transferred to you through your use of the website.

14. Third-party services and links

Our website may use or link to third-party services, including payment processors, shipping providers, social-media platforms, marketing services, and other applications.

Third-party services may be governed by their own terms and privacy policies. Agni Pickles is not responsible for the independent content or practices of third-party websites that we do not control.

This section does not limit our responsibility for service providers where responsibility cannot lawfully be excluded.

15. Website disclaimers and limitation of liability

We make reasonable efforts to keep the website available, secure, and accurate, but we do not guarantee uninterrupted access or that every website error will be corrected immediately.

To the fullest extent permitted by law, Agni Pickles will not be liable for indirect, incidental, special, or consequential losses resulting from use of the website or products.

This limitation does not apply to:

  • fraud or wilful misconduct;

  • personal injury or other loss for which liability cannot lawfully be excluded;

  • Agni Pickles’ obligations under applicable food-safety or labelling laws;

  • mandatory warranties or consumer remedies; or

  • any other right or liability that cannot legally be waived or limited.

You remain responsible for losses resulting from your failure to follow product labels, storage instructions, or safe-handling directions, to the extent permitted by law.

16. Events outside our reasonable control

Agni Pickles is not responsible for a delay or failure caused by an event outside our reasonable control, such as extreme weather, natural disaster, labour disruption, transportation interruption, government action, power or internet failure, or a serious supply-chain disruption.

If such an event prevents us from fulfilling a paid order, we will address the order according to our applicable policies and legal obligations.

17. Suspension, cancellation, and changes to these Terms

We may suspend access to the website or cancel an account where reasonably necessary to address security concerns, fraud, misuse, or a material violation of these Terms.

We may revise these Terms from time to time. The revised version will be posted on this page with a new “Last updated” date.

Changes apply prospectively and will not retroactively change an order already accepted. Material changes affecting an active subscription will be handled according to our Subscription Policy and applicable notice requirements.

Continued use of the website after revised Terms take effect constitutes acceptance of the revised Terms for future website use and purchases.

18. Governing law and consumer rights

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without excluding mandatory consumer protections that apply in your province or territory of residence.

Subject to those mandatory protections, the courts of Ontario will have non-exclusive jurisdiction over disputes arising from these Terms.

Nothing in these Terms waives a right or remedy that applicable law does not permit you to waive.

19. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

A failure by Agni Pickles to enforce a provision on one occasion does not waive the right to enforce it later.

These Terms, together with our policies, the information displayed at checkout, and any applicable order or subscription confirmation, constitute the agreement between you and Agni Pickles concerning your use of the website and purchases.
